The rescue of all persons in distress at sea – including illegal migrants – is an obligation under international maritime law, as well as being a long established humanitarian duty, says the International Chamber of Shipping (ICS). ICS is the global trade association for commercial ship operators, whose ships are currently involved on a daily basis in the rescue of refugees at sea in the Mediterranean.
Whatever may be decided by policy makers in EU Member States, the legal and humanitarian obligation of merchant ships to provide assistance to anyone in distress at sea will remain unchanged, says ICS.
Commenting on new reports that some European Union Ministers have expressed concerns that search and rescue operations have acted as a ‘pull factor’ for illegal migration, encouraging people to make dangerous crossings in the expectation of rescue, ICS notes that merchant ships are legally required to rescue persons in distress at sea by the UN International Maritime Organization’s Safety of Life at Sea Convention (SOLAS), to which virtually every maritime nation is a Party.
Under SOLAS, and the International Convention on Maritime Search and Rescue, the obligation of the ship Master to render assistance is complemented by a corresponding obligation of IMO Member States to co-operate in rescue situations, thereby relieving the Master of the responsibility to care for survivors, and allowing individuals who are rescued at sea in such circumstances to be delivered promptly to a place of safety.
The shipping industry is therefore very concerned by reports that the new EU Frontex operation ‘Triton’ will have a third of the budget of the current Italian ‘Mare Nostrum’ operation which it replaces, that its primary focus will be border control, and that search and rescue operations may be reduced in international waters.
It will clearly be much more difficult for merchant ships to save lives at sea without the adequate provision of search and rescue services by EU Member States. Moreover, whenever a ship performs its legal and humanitarian obligations, it will continue to be incumbent on EU Member States to ensure that those who are rescued can be readily disembarked at the next port of call, even when they may lack documentation.

L’Italia contribuisce a questa flotta con quasi la metà dei mezzi: un aereo, un pattugliatore d’altura e due pattugliatori costieri. Tra gli altri Paesi europei partecipanti ci sono anche Islanda (con una nave) e Finlandia (un aereo). Approdata al porto di Pozzallo (Ragusa) la nave „Fiorillo“ della Guardia costiera, con a bordo 276 profughi. Nel gruppo si sono 89 giovani centrafricani che hanno dichiarato di essere i superstiti di una traversata in cui una ventina di loro compagni sarebbero finiti in mare al largo della Libia, e sarebbero annegati.

You remember that the Libra was 40 km near by the ship during the afternoon and did nothing. They are co-responsable for the dead of more than 200 boat-people in that evening, and now they are presented as heroes!
Dal 26 agosto la „Migrant offshore aid station“ ha salvato 2.500 vite nel Mediterraneo. Con la contemporanea fine di Mare Nostrum, prevista per il 31 ottobre, „c’è il rischio che nessuno vada a salvare le persone in difficoltà“, è l’allarme lanciato dal fondatore Christopher Catrambone.
Missione terminata: non ci sono più soldi. Dopo 2.500 migranti salvati in due mesi (dal 26 agosto ad oggi) chiude la Migrant offshore aid station (Moas), prima missione di soccorso ai naufraghi dei barconi finanziata da privati. La chiusura avviene in contemporanea con la fine della Mare Nostrum (prevista il 31 ottobre), che di migranti, in un anno, ne ha salvati 150 mila, 409 al giorno. Al loro posto, da novembre comincerà Triton, missione finanziata dall’Unione Europea. A differenza di Moas e Mare Nostrum, Triton non ha mandato di monitorare i naufragi in acque internazionali. “Speriamo che chiunque sostituisca Mare Nostrum renda prioritario il salvataggio di vite umane”, commenta Christopher Catrambone, fondatore del Moas. La speranza, come ammette lo stesso imprenditore, rischia però di rimanere vana: “Abbiamo lavorato benissimo con Mare Nostrum, ma ora che la missione sta volgendo al termine e c’è il rischio concreto che nessuno vada a salvare i migranti in difficoltà”.
”Associare il virus Ebola ai viaggi della speranza e accusare l’operazione Mare Nostrum di una possibile epidemia nel nostro Paese è grave, rappresenta un modo di fare politica sporca, è un’idea che umilia il senso dello Stato e della comunità”.

The first the crew of the Antarctica knew of the disaster was a radio request to help a search and rescue operation. There were bodies in the water 200 miles off the coast of Malta. Two other ships – the Verdi and the Japan – were already at the scene, picking people out of the sea. The Antarctica was swiftly diverted and took command until the arrival of coastguard and naval ships.
