On February 28th 2017 the second level court hearing against ten of the Röszke 11 – all but Ahmed H., who was sentenced to ten years of prison in a separate trial – was held in Szeged. The only person remaining in Hungarian custody and therefore present at the court hearing was Yamen A. The other nine people have left Hungary some month ago and claimed asylum in other European countries. Albeit two of them left Europe under the “voluntary return” act due to the immense pressure imposed on them and the threat to deport them back to Hungary under the Dublin Regulation.

Kameras, Bewegungs- und Wärmesensoren: Der Grenzzaun zu Serbien und Kroatien, den Ungarn zurzeit errichtet, ist für Flüchtlinge fast unüberwindbar. Diese klagen schon jetzt über unmenschliches Verhalten.

Als er den Zaun zwischen Serbien und Ungarn überklettern wollte, wurde Shahid Khan von Grenzschützern geschnappt. Sie prügelten ihn und hetzen ihre Hunde auf ihn. „Als sie uns schlugen, lachten sie“, sagt Khan. Dann hätten die Polizisten Selfies mit ihm und anderen Flüchtlingen gemacht.

Ein neuer Zaun, den Ungarn gerade an der EU-Außengrenze zu Serbien baue, werde ihnen das Leben nun noch schwerer machen, sagt der 22-jährige Pakistaner.

Am 28. Februar 2017 findet in Ungarn ein Revisionsverfahren statt, in dem über das Schicksal von Yamen A. entschieden wird. Der 21-jährige Syrer ist seit September 2015 – also seit knapp eineinhalb Jahren – in Ungarn in Haft. Der Vorwurf: „Illegaler Grenzübertritt“ und „Teilnahme an Massenunruhen“. Im Juli letzten Jahres wurde er deshalb zu drei Jahren Gefängnis verurteilt. Dies ist sein Revisionsverfahren. Es findet in Szeged statt.
Yamen A. kam im Jahr 2015 als Flüchtender aus Syrien nach Europa. Er hatte in Syrien zuvor Psychologie studiert und floh vor der Zwangsrekrutierung der Armee aus dem Lande. Seit 17 Monaten sitzt er unschuldig im Gefängnis.

Testimony #6 – Cold

At a night in January I made an attempt to cross the Hungarian border. 48 people were with me, but 9 of them got scared just before the border fence and decided to go back. The rest of us succeeded and managed to get across the border onto the Hungarian side.

We were walking through the forest about 15 kilometers north of the border when we heard cars coming and decided to hide. 4 marked police cars arrived. There were around 15 policemen with trained dogs, heat-sensors and handguns. They saw us in the light. They rounded us up, and released dogs on us.

Then, without asking any questions first, the police officers started kicking and beating us. Afterwards they searched each of us, checking pockets and backpacks, destroying money and smartphones. Money was shred up in front of our faces, smartphones smashed on the ground. Policemen took out batteries and SIM cards from each phone and destroyed them separately.

Ahmed H. was sentenced to 10 years imprisonment because of „terrorism“ in November. On the 28th of February there will be a second level court trial about the other ten of the Röszke 11, who had their first verdict July last year. From these 10 people only Yamen A. is still in prison in Hungary. The other 9 people finished their sentence and left Hungary.

Yamen A. was sentenced to 3 years in the beginning of July last year. Since then he is in isolation imprisoned in Szeged. The “reason” why he was sentenced to greater punishment than the other 9 accused is that Yamen was talking 10 minutes to a megaphone on the 16th of September when thousands of people were protesting for the freedom of movement.

We call individuals and collectives to show their solidarity on the 28th of February with small or big actions!

Als Währungsspekulant hat George Soros Milliarden verdient. Geld, das er seit Jahrzehnten auch in humanitäre Hilfsorganisationen investiert. In Ungarn helfen sie Bürgern und Flüchtlingen, ihre Rechte wahrzunehmen. Der Regierung Orban ist das ein Dorn im Auge. Soros dient als Feindbild. Vielen europäischen Rechtspopulisten und Rechtsextremen gilt er als Inbegriff einer angeblichen jüdischen Verschwörung, auch in Deutschland. Die Folge in Ungarn: Soros-Hilfsorganisationen werden massiv bedroht – von der Regierung und der regierenden Fidesz.

Schon im Januar hat die österreichische Polizei acht Flüchtlinge zurück nach Ungarn geschoben. Nun sollen weitere Flüchtlinge illegal zurück nach geschoben worden sein, so der Vorwurf Ungarns gegen seinen Nachbarn.

Ungarn wirft dem westlichen Nachbarn Österreich vor, 58 Flüchtlinge „illegal“ über die Grenze nach Ungarn zurück geschoben zu haben. „Gemäß den Schengen-Regeln können derartige Abschiebungen nur in Absprache mit den ungarischen Behörden erfolgen“, sagte der Leiter der Grenzschutz-Abteilung der ungarischen Polizei, Laszlo Balazs, am Montag im staatlichen ungarischen Fernsehen. Eine solche Absprache habe es aber nicht gegeben.

On 14 February, the Hungarian government has submitted to Parliament a package of amendments to five acts: the Act on Asylum, the Act on the Admission and Right of Residence of Third-Country Nationals, the Act on State Border, the Act on Minor Offences and the Act on Child Protection and Guardianship Management. The Bill, titled “On the amendment of certain acts related to increasing the strictness of procedures carried out in the areas of border management” will be discussed during the spring session of Parliament and should take effect in late spring 2017.

Das mitteleuropäische Land will die Bewegungsfreiheit von Asylbewerbern massiv beschneiden: Künftig sollen sie in Lagern an den Grenzen das Asylverfahren abwarten. Menschenrechtler laufen Sturm.

Ungarn hat angekündigt, Migranten in grenznahen Lagern in Schiffscontainern unterzubringen, solange ihre Asylanträge bearbeitet werden. Zudem sollten alle Flüchtlinge, die ohne Genehmigung in dem Land seien, zu diesen Lagern gebracht werden, teilte der Stabschef von Ministerpräsident Viktor Orbán, János Lázár, am Donnerstag mit.

In 2015 only 20-30 persons per day were let in at each transit zone. From 2 November 2015, only 10 persons are let in per day and only through working days, due to the changes in working hours of the IAO. From January 2017, only 5 persons are let in per day in each transit zone […].

The clear factors that determine who is allowed access to the transit zone are time of arrival and extent of vulnerability. The other determining factors are not so clear. In Röszke there are three separate lists for those waiting: one for families, one for unaccompanied minors and one for single men. In Tompa there is a single list containing the names of all three groups. Both lists are managed by a so-called community leader or list manager who is chosen by the people waiting at the given place and who communicates both with the Serbian and Hungarian authorities. The HHC already received a complaint of an asylum seeker about serious violations committed by one of such community leader (forced sex and beating allegations).

The Hungarian authorities allow people into the transit zones based on these lists. Families with small children enjoy priority over single men and usually some unaccompanied minors are also allowed entry on any given day. However, there are other determining factors when it comes to entry, which are not so clear and not knowing them further frustrates those waiting.
