L’avvocata libica che ha portato in tribunale l’accordo con l’Italia sui migranti

È l’avvocata più famosa della Libia, vive tra il Canada e Tripoli, e si occupa da tempo di diritti umani in uno dei paesi più complicati del mondo. Ora Azza Maghur, insieme ad altri cinque connazionali, ex politici e giuristi, ha presentato un ricorso in tribunale contro il memorandum d’intesa tra Tripoli e Roma firmato lo scorso 2 febbraio dal presidente del consiglio italiano Paolo Gentiloni e dal premier del governo di unità nazionale libico (Gna) Fayez al Sarraj. L’accordo dovrebbe fermare il flusso di migranti che arrivano sulle coste italiane attraversando il mar Mediterraneo. Ma secondo Maghur, figlia di un ex ministro degli esteri e ambasciatore della Libia presso le Nazioni Unite, l’intesa è illegittima e incostituzionale.

Il 22 marzo la corte d’appello di Tripoli ha accolto il ricorso, ha dato ragione a Maghur e ai suoi colleghi e ha sospeso il memorandum, in attesa delle udienze del processo. “È solo il primo passo di questa battaglia legale”, dice l’avvocata a Internazionale. “Le istituzioni statali libiche sono deboli e la loro autorità è contestata”. Il governo di Tripoli guidato da Al Sarraj, l’unico riconosciuto dall’Italia e dalla comunità internazionale, è in un momento di particolare vulnerabilità. La Russia sembra pronta a un ritorno in Nordafrica e corteggia il maresciallo Khalifa Haftar sostenuto dal parlamento di Tobruk che è stato eletto nel 2014 e non riconosce l’autorità del governo di unità nazionale insediato a Tripoli.

POZZALLO. A bordo della nave ‚Golfo azzurrò sono arrivati nel porto di Pozzallo 428 migranti, in maggioranza uomini e prevalentemente di nazionalità marocchina (più di 300). Diciannove i minori non accompagnati. Due uomini ricoverati: un traumatizzato colpito con tubo di ferro in Libia prima della partenza e un diabetico. La Polizia è già al lavoro per individuare i presunti scafisti.

Yet more migrants drown

A 16 year-old Gambian boy appears to have been the only one of some 150 migrants to survive when their inflatable sank yesterday off the coast near Sabratha.

The boy was picked up by a Spanish frigate, transferred to an Italian vessel and landed in Lampedusa. Safely ashore, he said that those on the raft with him had included five children and several pregnant women.

All had drowned, the International Organisation for Migration (IOM) told Reuters. The boy had survived by grabbing a fuel tank after the raft began to deflate and take water. He added that the migrants had been launched from Sabratha.

Yesterday, the Sabratha’s mayor said that the municipality had lost control over local fuel smugglers. He did not mention people smugglers, who appear to operate just as freely as those who are stealing subsidised fuel from under the noses of the authorities.

The updated country report on Greece provides a thorough analysis of the transformation of the Greek asylum system in the light of the closure of the Western Balkan route and the EU-Turkey statement. The report offers detailed statistics and practical insights into the workings of the asylum procedure, reception and detention of asylum seekers, as well as content of international protection.

Substantial asylum reforms, many of which driven by the implementation of the EU-Turkey statement, took place in 2016. Law (L) 4375/2016, adopted in April 2016 and transposing the recast Asylum Procedures Directive into Greek law, was subsequently amended in June 2016 and March 2017, while a draft law transposing the recast Reception Conditions Directive has not been adopted yet.

The impact of the EU-Turkey statement has been a de facto divide in the asylum procedures applied in Greece. Asylum seekers arriving after 20 March 2016 are subject to a fast-track border procedure and excluded from relocation in practice.

When arriving in Athens at the beginning of August 2015, I was still thinking about the Euro-crisis and the developments in Greece. Just about a month before, an overwhelming majority of the Greek population had rejected the measures proposed by the EU Commission, and just a few days later, the Syriza-ANEL-government conceded to an agreement, which followed from the notorious marathon-summit in Brussels and which imposed even harsher measures than those rejected by the referendum. The roller-coaster ride of the last six months – from the election victory of Syriza in January 2015 via the preliminary agreement on February 20, when both the Greek state’s finances and the perceived window of opportunity were rapidly shrinking, up to the referendum and the imposition of the third memorandum – had come to a crashing halt. It seemed like an utter defeat of a left and democratic project in, and for Europe. I expected the social movements to be apathetic and paralysed. Weiterlesen »

Seventeen held after activists prevent departure of flight taking asylum seekers and other migrants to Nigeria and Ghana

Police have arrested 17 anti-deportation protesters who locked themselves to an aircraft at Stansted airport, preventing a charter flight due to remove asylum seekers and other migrants from the UK from taking off.

The protesters locked themselves to the wing of a Titan Airways flight and refused to move. All 17 protesters involved with the action have been arrested on suspicion of aggravated trespass and are now in police custody.

Essex police said they had received reports that a group of protesters gained access to Stansted airport’s airside at about 9.30pm on Tuesday night. A spokesman said: “We were contacted by Stansted airport after protesters entered and locked themselves on to an aircraft destined for Nigeria. Officers remain at the scene to carry out further investigations. Inquiries are ongoing.”

Cobran más de mil euros por un ‚billete‘ en una patera, prefieren a magrebíes, extorsionan, secuestran… las redes que se enriquecen a costa de la desesperación

Es muy fácil traficar con la desesperación. No hay mucho que negociar cuando una de las dos partes está dispuesta a jugarse la vida con tal de escapar de un país para buscarse otra a toda costa. Y hay quien se aprovecha sin escrúpulos de esa desesperanza y pone precio al mercadeo ilegal de personas para embolsarse miles de euros al mes.

En lo que va de año se han recogido de aguas del Estrecho 18 cadáveres, los tres últimos este pasado viernes. Otros muchos lo rozaron. Estuvieron cerca de lograrlo. Más de dos mil han sido rescatados o detenidos cuando ni siquiera se ha completado el primer trimestre de este año. Según datos recogidos por la Subdelegación del Gobierno, ha habido un aumento en la llegada de inmigrantes a la costa gaditana del 135 por ciento con respecto a 2016. Además, el desembarco inusual de dos pateras en una playa de El Puerto la semana pasada acercaba el drama a la Bahía. La presión migratoria ha aumentado notablemente y ese incremento de circulación de pateras también ha provocado la proliferación y el enriquecimiento de las mafias que controlan este dramático ’negocio‘ desde las costas de Marruecos. In einer gemeinsamen Erklärung betonen die tunesische und die italienische Regierung, dass das Abkommen zur Migrationsbekämpfung keine EU-Lager in Tunesien einschließt. Wie die gemeinsamen italienisch-tunesischen Maßnahmen zur Migrationsbekämpfung aussehen, wird nicht publik gemacht.

Meno sbarchi tunisini in Europa, non pronta accoglienza da Libia

(ANSAmed) – ROMA, 21 FEB – Dopo la grande ondata di migranti tunisini riversatisi sull’isola di Lampedusa dopo la rivoluzione contro il presidente Ben Ali, l’accordo bilaterale tra Roma e e Tunisi dell’aprile 2011 ha fatto registrare una diminuzione degli arrivi dai 22.000 del 2011 ai 605 del 2014. Poi vi è stato nuovo aumento nel 2015 e nel 2016, con 1204 ingressi di irregolari e 1.711 rimpatri, secondo fonti tunisine.

Der tunesische Ministerpräsident sagte bei seinem Berlin-Besuch zweimal deutlich „nein“ in die Kamera, auf die Frage, ob EU-Lager in Tunesien aufgebaut werden könnten. Die EU – vorab die deutsche und die italienische Regierung – wollen abgefangene Boat-people in nordafrikanischen EU-Lager bringen und damit die Flucht über das zentrale Mittelmeer zum Erliegen bringen.

Vor dem tunesischen Ministerpräsidenten zogen alle drei libyschen „Regierungen“ – UN-Regierung, Tripolis-Regierung, Tobruk-Regierung – ihre Bereitschaft zurück, über EU-Lager auf libyschem Boden mit der EU zu verhandeln. Auf Malta hatten die Chefs der EU-Mitgliedsstaaten bereits eine entsprechende Agenda beschlossen, sie stießen auf antikolonialistisches Granit.

Frontex hat die Staatsanwaltschaft Catania dazu veranlasst, die NGO Initiativen zur Seenotrettung im Mittelmeer zwischen Libyen und Sizilien aufs Korn zu nehmen. Italienische Medienberichte legten nahe, dass bereits ermittelt würde, nun rudert Staatsanwalt Carmelo Zuccaro zurück: Es sei kein Verfahren eröffnet worden, aber die NGO-Seenotrettung sei in die staatsanwaltschaftliche Beobachtung der Schleuserkriminalität im zentralen Mittelmeer integriert worden. Als Grund gab Zuccaro an, dass der Einsatz teuer High-Tech-Aufklärung und sogar von Drohnen durch die Seenotrettungs-Initiativen „anormal“ sei

Das zentrale Mittelmeer wird derzeit elektronisch durch EU und USA stärker überwacht als jede andere Meereszone. Dennoch ertranken vor den High-Tech-Augen der EU- und US-Militärs in den letzten Jahren Abertausende Menschen, allein im letzten Jahr 5.000 Boat-people. Die NGO-Seenotrettungen kämpfen verzweifelt darum, Schiffsbrüchige in der Todeszone vor Libyen rechtzeitig zu erkennen, um sie retten zu können. Die dafür eingesetzten High-Tech-Mittel sind nur ein bescheidener Anfang und stehen in keinerlei Vergleich zu den hochmodernen milliardenschweren Maxi-Techniken der Abschotter.
