The Choucha camp is closing. The UNHCR will apparently not renew the contracts of the camp workers, some of which are ending in November (for instance in the kitchens). It was announced to rejected refugees that, according from the end of Novembre, they will not have access to the camp services anymore (food, electricity, medical care…). IOM returns should also take end in November. In the mean time, some refugees are organizing a sit-in at the camp entrance. They refuse local integration in Tunisia as offered to people registered after the end of the resettlement program.

Le camp de Choucha est en train de fermer, le HCR ne renouvellera pas les contrats des travailleurs du camp dont certains se terminent au mois de novembre (notamment aux cuisines), et a annoncé aux réfugiés non statutaires qu’ils n’auraient plus droit à rien (nourriture, électricité, assistance en tout genre) à partir de fin novembre. Les retours OIM se termineraient aussi à la même date. Des réfugiés organisent un sit-in à l’entrée du camp, notamment pour refuser la proposition de projets d’integration locale en Tunisie pour les réfugiés enregistrés après la fin du programme de réinstallation. Cela car ils considèrent que la Tunisie n’est pas à même de les traiter à égalité avec le reste des citoyens. Ces positions font suite à plusieurs actes racistes et abus des réfugiés partis travailler dans la ville de Ben Guardane.

Background to the event:
In an attempt to prevent „irregular migration“ from Africa to Europe, some European countries implement border control measures outside their own territory, at sea and on land. States have reached agreements to intercept boats at sea and return people to countries in West and North Africa, in circumstances that expose people to serious human rights violations. As there is an almost complete lack of transparency surrounding many European countries‘ border management practices and agreements with North and West African states, these violations go unchecked.

The award-winning documentary „Closed Sea“ gives a unique insight into the consequences of migration control policies for real people. It aims to tell the story of a group of African refugees who were pushed back to Libya by the Italian authorities. In the documentary, the witnesses of these push-back policies talk about what happened to them on the boats and after they were returned to Libya. The makers met their witnesses in Shousha refugee camp, at the border between Libya and Tunisia, and in two reception camps for asylum seekers (C.A.R.A.) in southern Italy. The interviews constitute the main part of the documentary, along with a session of the European Court of Human Rights in Strasbourg, in the landmark case Hirsi Jamaa and others v. Italy. In the final judgment delivered in February 2012, the European Court of Human Rights found that a push-back operation conducted by Italy in May 2009 violated the European Convention on Human Rights.

Amnesty International organises this event as part of its campaign “When you don’t exist”, which aims to improve the protection of human rights for migrants, refugees and asylum-seekers in Europe and its borders. Under the slogan “S.O.S. Europe”, Amnesty’s campaign seeks to shine a light on human rights violations at the borders of Europe and aims to hold those who are responsible to account. Flüchtlingsunterbringung: Der Notstand bricht aus

Zelte für Flüchtlinge in Zirndorf / Konflikt innerhalb der CSU bricht offen aus / Flüchtlingsrat: Lagerpflicht sofort abschaffen

Die Zahl der Flüchtlinge, die nach Deutschland kommen, steigt weiter an. Während andere Bundesländer ihre Unterbringung überwiegend reibungslos meistern, bricht in Bayern der offene Notstand aus: Die für 500 Personen ausgelegte Erstaufnahmeeinrichtung (EA) in Zirndorf ist mit fast 800 Personen total überfüllt, weshalb das Bayerische Rote Kreuz heute Nachmittag mit dem Aufbau beheizter Zelte beginnt, um eine Unterbringung gewährleisten zu können.

Dieser Notstand ist die Folge der rigiden Lagerpflicht für Flüchtlinge in Bayern. Andere Bundesländer können erheblich flexibler reagieren und Flüchtlinge nach der EA in Wohnungen unterbringen. In Bayern müssen sie stattdessen in Flüchtlingslagern leben. Diese sind jedoch genauso überfüllt, wie die EAs in Zirndorf und München. Deshalb verbleiben neu angekommene Flüchtlinge wesentlich länger in der EA, als die vorgesehenen drei Monate. Aus purer Not heraus werden die Landkreis und kreisfreien Städte in die Pflicht genommen, innerhalb von 3-4 Tagen Kontingente von 15-20 Personen unterzubringen. Damit steht die bayerische Lagerpflicht grundsätzlich in Frage: Obwohl sie in Lagern untergebracht werden müssten, kommen die meisten neu angekommenen Flüchtlinge in Wohnungen oder Pensionen.

Derweil bricht innerhalb der bayerischen CSU der Konflikt um die bayerische Asylpolitik offen aus. Innenminister Joachim Herrmann und Sozialministerin Christine Haderthauer wollen zwar strikt an der bayerischen Lagerpflicht für Flüchtlinge festhalten. Die CSU-Abgeordneten im Sozialausschuss des Bayerischen Landtags forderten gestern hingegen eine grundsätzliche Überprüfung der Asylpolitik in Bayern. Anlass war eine Petition der Flüchtlinge aus Würzburg, die sich derzeit auf einem Protestmarsch nach Berlin befinden, und mit ihrer Petition u.a. die Abschaffung der Lagerpflicht und der Versorgung mit Essenspaketen fordern. Die CSU-SozialpolitikerInnen brechen damit zum ersten mal öffentlich mit der Hardliner-Position ihrer Partei und positionieren sich damit offen gegen die CSU-MinisterInnen Herrmann und Haderthauer.

„Die Macht des Faktischen führt der Bayerischen Staatsregierung gerade nachdrücklich vor Augen, dass die bayerische Lagerpolitik am Ende ist. Die Mehrheit der neu ankommenden Flüchtlinge wird bereits in Wohnungen und Pensionen untergebracht, was wir ausdrücklich begrüßen. Die Lagerpflicht kann hingegen nicht mehr durchgesetzt werden. Herrmann und Haderthauer sind nun in der Pflicht, die Gesetzeslage der Realität anzupassen und die rigide Lagerunterbringung zu beenden – und das sofort!“ fordert Alexander Thal, Sprecher des Bayerischen Flüchtlingsrats.

RCM’s (Regional Center for Minorities) press-release about the situation outside of the Centre for Asylum Seekers in Bogovađa — the centre has run over its capacity for months, until the management decided to stop accommodating the surplus of people and now around a hundred asylum seekers are staying outside, without shelter, water or food. The situation is becoming drastic, with the falling temperatures.

Worrying situation outside of the Centre for Asylum Seekers in Bogovađa

Belgrade, September 25, 2012 – The Regional Centre for Minorities strongly condemns the worrying situation outside of the Centre for Asylum Seekers in Bogovađa, which our activists visited on the 12th of September. Between eighty and a hundred asylum seekers are staying outside, as the centre has reached its maximum capacity of 150 people.

The basic human rights of the people outside of the centre are endangered – they do not have a roof over their head, access to water, basic sanitation and adequate nutrition. In other words, both their life and their right to a dignified life are endangered.

With this treatment of asylum seekers, the Serbian state is breaking its own laws, as well as international standards, which state that everyone who seeks asylum should be accommodated, and their basic needs provided for, within 72 hours, and until the final decision on their asylum claim has been reached.

The Centre for Asylum Seekers in Bogovađa is, besides the centre in Banja Koviljača, the only centre of this kind in Serbia. Asylum seekers were first accommodated there in June 2011. After racist mobilisations in Banja Koviljača in October 2011, many asylum seekers were relocated to Bogovađa and the centre soon exceeded, its capacity. Thus in July 2012, 229 were accommodated in the centre.

As the number of asylum seekers in Serbia keeps rising, the existing centres are too small to accommodate everybody. However, the Commissariat for Refugees of Republic of Serbia (KIRS), responsible for the accommodation of asylum seekers, has not been opening new centres. Besides, the Centre in Bogovađa reduced the number of people it accommodates to the official maximum capacity of 150 people. The reason for this could be that the costs of accommodating one person for one night is 8 euros, according to the words of a representative of KIRS.

The asylum system in Serbia has serious shortcomings. Since 2008, when the independent asylum system started in Serbia, nobody has been granted refugee status. This means that Serbia is effectively not a country in which migrants could permanently regularise their status, through claiming asylum. However, many undocumented migrants in Serbia seek asylum, because this is the only way for them to gain a temporary legal status and have at least temporary access to basic rights, such as a roof over their head and health-care. It is thus disgraceful to see that, even after they have claimed asylum, migrants are not accommodated in the centers and need to continue to sleep outside.

The Regional Centre for Minorities demands that the authorities find a solution for accommodating the asylum seekers, who are now staying without a shelter in front of the centre in Bogovađa as soon as possible, especially as the weather conditions are becoming more and more difficult and could gravely exacerbate an already worrying situation. We also believe that it is urgent to end the human rights violations and to ensure the compliance with the standards, which represent the minimum of the state’s obligations towards these people — and include providing them with the means necessary for their survival.

Im Rahmen des Projekts boats4people hat eine internationale Delegation  bestehend aus 11 Personen aus 9 verschiedenen Ländern am 11.7.2012 das Flüchtlingslager Shousha in Tunesien wenige Kilometer vor der libyschen Grenze besucht. Unter den TeilnehmerInnen befand sich auch eine Vertreterin von borderline-europe, Menschenrechte ohne Grenzen e.V.

Ankunft von 201 Choucha-Flüchtlingen in Deutschland am 03.09.2012

Am 03.09.2012 werden 195 Flüchtlinge aus dem Lager Choucha (Tunesien) im Rahmen des UNHCR-Resettlement-Programms nach Deutschland ausgeflogen. 6 weitere Flüchtlinge werden aus medizinischen Gründen mit aufgenommen. Sie alle hatten 18 Monate in dem Wüstenlager ausharren müssen. Der Dänische Flüchtlingsrat hatte in Vorbereitung Deutschkurse organisiert, die IOM kulturelle Orientierungskurse. Das gab der UNHCR am 31.08.2012 bekannt. Derzeit sind noch 2.211 Flüchtlinge in dem Lager. 1.320 von ihnen warten auf den Abflug per Resettlement-Programm. 635 warten auf eine Resettlement-Entscheidung. Für die übrigen 250 Flüchtlinge sollte eine „lokale Lösung“ gefunden werden, so der UNHCR.

Abba Mussei Zerai berichtet am 24.08.2012 über das Lager Hums im Osten von Tripolis. Am 23.08.2012 haben dort Militärs 3 Flüchtlinge erschossen, die ohnehin gespannte Situation eskaliert. Abba Mussei Zerai macht die EU für die Existenz dieser Lager in Libyen verantwortlich.

A massacre of asylum seekers in detention center Hums east of Tripoli.

The situation of refugees Sub-Saharan Africans in Libya is proving more and more hell. Increased to three people killed by Libyan soldiers. It all started yesterday morning and throughout the day there was a high tenzion between refugees and military until that late in the evening, the military said in the supervision of the detention center for asylum seekers to Hums east of Tripoli, where they are detained hundreds of asylum seekers and political refugees, already recognized by UNHCR in Sudan, pacificamnte protesting against the appalling conditions of detention, ill-treatment and can even killings, as happened last night. Opposite to the demands and hunger strike deployed by desperate women by living conditions, lack of respect for their human dignity, women who are pregnant need of medical supervision and assistance that does not receive anything, the response of the Libyan military and was to beat up a guy like carpio offering, and then shoot him for no reason. The soldiers also shot against women screaming in front of the killing of one of their companions, the soldiers beat and shot against women to reduce them to silence.
The latest updates from Tripoli which increased to three died under the blows of the Libyan military, this is a crime against humanity, and in total violation of human rights and international conventions protecting the rights of refugees.
The death of these three applicants in a detention center in Libya, is a serious act of acusa to Europe that guarding agreements with Libya today is not different at all from Libya yesterday with Ghedaffi, indeed Libya today proves to be more violent than during the dictatorship of Colonel. All this is happening while killing to prevent refugees from reaching the fortress Europe. European pressure to close the doors of Europe is costing the lives of many refugees.
I appeal to the European Parliament to act decisively on the government in Tripoli, the references to respect for human rights and the rights of asylum seekers. Free all refugees, and deliver them into the hands of the UNHCR has a duty to ensure that these people international protection.
