Italienische RechtsanwältInnen berichten über die Lage von Flüchtlingen in Italien und diskutieren

Seit mehreren Monaten leben in Hamburg rund 300 Kriegsflüchtlinge, die im Jahr 2011 aus Libyen nach Italien geflohen sind, in vollständiger Unsicherheit. Sie mussten nach dem NATO-Krieg Libyen verlassen und machten sich auf die gefährliche Überfahrt nach Italien. Die italienischen Behörden gaben ihnen humanitäre Aufenthaltstitel und forderten sie auf, weiter gen Norden zu reisen.

Die Flüchtlinge von „Lampedusa in Hamburg“ fordern von der Stadt Hamburg und der Bundesregierung, nach §23 Aufenthaltsgesetz als spezifische Gruppe vor dem Hintergrund des Kriegs und der NATO Intervention in Libyen sowie der humanitären Notlage in Italien aufgenommen zu werden. Die Bundesregierung begründet ihre ablehnende Haltung damit, dass in Italien grundsätzlich ein angemessener Umgang mit Flüchtlingen gewährleistet sei. Seit 2010 entschieden aber mehr als 250 bundesdeutsche Verwaltungsgerichte, dass eine Rückführung von Flüchtlingen nach Italien rechtswidrig ist.

Loredana Leo und Salvatore Fachile werden über die brutale Realität von Flüchtlingen in Italien berichten. VertreterInnen von Lampedusa in Hamburg werden ebenfalls dabei sein und uns an ihren eigenen Erfahrungen teilhaben lassen.

Italian lawyers report on the situation of refugees in Italy

With the lawyers Loredana Leo and Salvatore Fachile  from Rome, Speakers of Lampedusa in Hamburg and lawyer Björn Stehn Hamburg.

„We need to define a European law on asylum so that asylum seekerscan apply for asylum
in Europe, not in Italy or Greece. (…) The struggle must be fought directly by the people concerned, so that in the near future – not at some point – a fundamental right will be realized: The right to asylum in Europe, not in individual states.“ (Salvatore Fachile, 2013)

The two lawyers are experts of the brutal reality for refugees in todays Italy and will inform about the difficult legal situation for refugees in Italy concerning their right to stay.

For several months now about 300 war refugees who fled in 2011 from Libya to Italy live in Hamburg in complete uncertainty. Neither Hamburg feels responsibility for them nor the German Federal Government, which just recommends their deportation to Italy as soon as possible.

During and after the NATO war thousands of war refugees left Libya and made their dangerous crossing to Italy, the Italian authorities gave many of them a humanitarian residence permit, some cash or a ticket and forced them to travel further to the north. The EU program NORTH AFRICA, a temporary financial support for the war refugees from Libya during the NATO war, had expired in early 2013.

Italy — already long time unable to cope with the refugee situation – decided with this clever gesture, to get rid of the refugees, to leave their responsibility and to forward them to the center of Europe. The residence permits were issued for this purpose only.

The refugees of „Lampedusa in Hamburg“ confront the City of Hamburg and the Federal Government with their demand to be included as a specific group in the context of war and NATO intervention in Libya and the humanitarian emergency in Italy. Such a group recognition by § 23 in the German Residence Law, is possible for every Federal German State, in consultation with the Federal Ministry of the Interior. However, both the City of Hamburg and the Federal State refuse to accept the responsibility and throw the balls to each other. The federal Government claims that in Italy generally appropriate treatment of refugees is guaranteed. The always presented attitude of the political leaders that their hands are tied, is a lie to cover oneself  by which the lives of those affected will be exposed to great danger.
In reality, their claim for a human treatment was refused in Italy.

Since 2010, more than 250 German administrative courts, decided that a return of refugees to Italy is illegal. „The living conditions for vulnerable make the fear realistic that the people there will face inhuman or degrading treatment,“ it says in judgments.

Loredana Leo and Salvatore Fachile are lawyers from Italy, specialized in refugee issues and are engaged in refugee topics especially concerning their living conditions in Italy for already many years.

They will tell how life is in Italy for refugees, what kind of  brutal reality they face in the Italian law. Representatives of „Lampedusa in Hamburg“ will also be there and share with us their own experiences.

Hamburg has to show that it’s city’s motto „Welcome to Hamburg“ is not just a slogan. Hamburg as a rich metropolis has to face the responsibility to receive people here. The responsibility for deprivation and exclusion lies in  the European system of refugee and migration control. Particularly Germany, which has substantially no external EU border, has promoted this system of irresponsibility and is one of the main beneficiaries.

  • Asylum seekers have the right to seek shelter there where they want!
  • For  a Europe that says Welcome!
