Subject: Current legal and practical issues, obstacles and best practices in the field of

judicial cooperation in criminal matters between the EU Member States and the Southern neighbours of the EU (Algeria, Egypt, Israel, Jordan, Lebanon, Libya, Morocco, Palestinian Authority, Syria and Tunisia) and possible further steps

Purpose

The present document has been prepared in view of the Strategic Seminar on Judicial Cooperation  in Criminal Matters between the EU Member States and Southern neighbours of the EU co­organised by Eurojust, the Cyprus Presidency of the EU, the Attorney General of the Republic of Cyprus and the European Commission (DG Enlargement – TAIEX), which will be held on 3-5 October 2012, in Limassol, Republic of Cyprus. It has been prepared solely on the basis of the replies provided by the Member States to a questionnaire prepared by Eurojust (see Annex 1).

It consists of:

  1. a summary of the current legal and practical issues, obstacles and best practices in four areas of judicial cooperation in criminal matters (mutual legal assistance, extradition, transfer of criminal proceedings and transfer of sentenced persons) between the EU Member States and the Southern neighbours of the EU (Algeria, Egypt, Israel, Jordan, Lebanon, Libya, Morocco, Palestinian Authority, Syria and Tunisia);
  2. an overview of the legal basis applicable in the four areas of judicial cooperation in criminal matters between each EU Member State and each Southern neighbour of the EU;
  3. statistics on requests concerning the same four areas of judicial cooperation in criminal matters issued to and received by each Member State with respect to each Southern neighbour of the EU, and
  4. possible further steps.
