L’avvocata libica che ha portato in tribunale l’accordo con l’Italia sui migranti

È l’avvocata più famosa della Libia, vive tra il Canada e Tripoli, e si occupa da tempo di diritti umani in uno dei paesi più complicati del mondo. Ora Azza Maghur, insieme ad altri cinque connazionali, ex politici e giuristi, ha presentato un ricorso in tribunale contro il memorandum d’intesa tra Tripoli e Roma firmato lo scorso 2 febbraio dal presidente del consiglio italiano Paolo Gentiloni e dal premier del governo di unità nazionale libico (Gna) Fayez al Sarraj. L’accordo dovrebbe fermare il flusso di migranti che arrivano sulle coste italiane attraversando il mar Mediterraneo. Ma secondo Maghur, figlia di un ex ministro degli esteri e ambasciatore della Libia presso le Nazioni Unite, l’intesa è illegittima e incostituzionale.

Il 22 marzo la corte d’appello di Tripoli ha accolto il ricorso, ha dato ragione a Maghur e ai suoi colleghi e ha sospeso il memorandum, in attesa delle udienze del processo. “È solo il primo passo di questa battaglia legale”, dice l’avvocata a Internazionale. “Le istituzioni statali libiche sono deboli e la loro autorità è contestata”. Il governo di Tripoli guidato da Al Sarraj, l’unico riconosciuto dall’Italia e dalla comunità internazionale, è in un momento di particolare vulnerabilità. La Russia sembra pronta a un ritorno in Nordafrica e corteggia il maresciallo Khalifa Haftar sostenuto dal parlamento di Tobruk che è stato eletto nel 2014 e non riconosce l’autorità del governo di unità nazionale insediato a Tripoli.

POZZALLO. A bordo della nave ‚Golfo azzurrò sono arrivati nel porto di Pozzallo 428 migranti, in maggioranza uomini e prevalentemente di nazionalità marocchina (più di 300). Diciannove i minori non accompagnati. Due uomini ricoverati: un traumatizzato colpito con tubo di ferro in Libia prima della partenza e un diabetico. La Polizia è già al lavoro per individuare i presunti scafisti.

Yet more migrants drown

A 16 year-old Gambian boy appears to have been the only one of some 150 migrants to survive when their inflatable sank yesterday off the coast near Sabratha.

The boy was picked up by a Spanish frigate, transferred to an Italian vessel and landed in Lampedusa. Safely ashore, he said that those on the raft with him had included five children and several pregnant women.

All had drowned, the International Organisation for Migration (IOM) told Reuters. The boy had survived by grabbing a fuel tank after the raft began to deflate and take water. He added that the migrants had been launched from Sabratha.

Yesterday, the Sabratha’s mayor said that the municipality had lost control over local fuel smugglers. He did not mention people smugglers, who appear to operate just as freely as those who are stealing subsidised fuel from under the noses of the authorities.

Bei der Überfahrt nach Griechenland sind mindestens elf Flüchtlinge vor der türkischen Küste ertrunken. Ein Schlauchboot mit 22 Menschen an Bord kenterte nahe der griechischen Insel Samos, wie türkische Medien berichten.

Die türkische Küstenwache konnte sieben Menschen retten, vier werden immer noch vermisst. Das Flüchtlingsboot sei in der Ägäis auf der Höhe der Provinz Aydin gekentert. Elf Tote seien am Strand geborgen worden, berichten türkische Medien übereinstimmend.

Die Nachrichtenagentur Dogan zeigte Bilder der an der Küste angeschwemmten Leichen. Die Flüchtlinge, deren Nationalität nicht mitgeteilt wurde, wollten vermutlich auf die griechische Insel Samos, die gegenüber dem türkischen Distrikt Kusadasi liegt.

A Tripoli court has blocked any deal on migrants resulting from the memorandum of understanding (MoU) signed by Presidency Council (PC) chief Faiez Serraj and the Italians this February. It is however unclear what impact today’s ruling will have on the EU’s determination to try and stem the migrant tide in cooperation with the PC.

The case was brought by six individuals including former justice minster Salah Al-Marghani and lawyer Azza Maghur‏. Their petition did not simply deal with the controversial plans outlined in the memorandum, which included for the return of migrants to camps in Libya. They also disputed the ability of Serraj to make such a deal on behalf of the Government of National Accord (GNA). This is because according to the Libyan Political Agreement, until it is approved by the House of Representatives, the GNA along with the State Council, has no legal standing.

More than 200 migrants are feared dead in a boat sinking off the coast of Libya, a Spanish aid organisation says.

Proactiva Open Arms said it had recovered five bodies floating near two capsized boats, which can each hold more than 100 people.

The group’s Laura Lanuza said the five they pulled from the Mediterranean were young men who appeared to have drowned.

A spokesman for Italy’s coast guard, which co-ordinates rescues, confirmed the five deaths, Reuters reports.

Otras tres personas han sido rescatadas del agua y cerca de una veintena ha huido al llegar al Puerto de Santa María

La Guardia Civil y la Policía Nacional han detenido este martes a una treintena de personas que han llegado a la costa de El Puerto de Santa María (Cádiz) a bordo de dos pateras, han informado a Efe fuentes del operativo.

Otras tres personas han sido rescatadas del agua y cerca de una veintena ha huido al llegar a la costa, por lo que la Guardia Civil y la Policía Nacional mantienen un operativo de búsqueda en la zona.

Las dos embarcaciones llegaron sobre las seis de la mañana a la playa de La Muralla de El Puerto de Santa María. En ellas, según las estimaciones de la Guardia Civil, viajaban unas cincuenta personas, que, nada más llegar a tierra, echaron a correr.

Plus de 150 000 tentatives d’immigration illégale vers l’Espagne ont été avortées au cours des cinq dernières années (2012-2016), indique l’agence EFE, qui cite la police marocaine. En outre, 392 réseaux de trafic d’être humains ont été démantelés, d’après les chiffres du ministère chargé des affaires de la migration.

Le pic de sorties illégales en direction du voisin ibérique a été atteint en 2014 : cette année-là, la police a freiné les projets migratoires de 37 816 personnes et démantelé 105 réseaux. Entre 75% et 80% des migrants sont présument originaires des pays d’Afrique subsaharienne.

Ces chiffres diffèrent quelque peu de ceux de la police espagnole, qui comptabilise 20 000 tentatives d’immigration illégale vers Ceuta et Melilla pour l’année 2014 – les embarcations de fortune ne sont pas prises en compte -, précise l’agence de presse espagnole.

Das Jahr 2017 ist noch nicht alt, aber es hat schon traurige Rekorde erzielt: Seit dem 1. Januar sind bereits mehr Flüchtlinge im zentralen Mittelmeer ertrunken als im gleichen Zeitraum des vergangenen Jahres: Insgesamt 481 Männer und Frauen haben die gefährliche Passage auf ihren überfüllten und seeuntauglichen Booten nicht überlebt, wie die UN-Migrationsorganisation IOM am Wochenende bekannt gab.

Damit sind auf dieser Route fast fünfmal so viele Bootsflüchtlinge wie in den ersten Monaten 2016 umgekommen. 16.185 Menschen erreichten Italien lebend, rund 50 Prozent mehr als im Vorjahr. Von denen, die sich auf die riskante Passage nach Europa machten, starb jeder Dreiunddreißigste – auch dies ein neuer Rekord.

L’Algérie se rebelle contre le diktat européen

L’absence de l’Algérie à la table des ministres de l’Intérieur d’une partie du Maghreb, conviés dans la capitale italienne aux côtés de leurs homologues de France, Allemagne, Autriche, Slovénie, Suisse, Malte et Italie, signifie un camouflet pour le gouvernement de Paolo Gentiloni.

Car seuls deux pays de la rive sud, Tunisie et Libye, ont signé l’accord de lutte contre l’immigration illégale. Un déplacement à Rome presque inutile pour les ministres de ces deux pays, vu que l’Italie avait à peine paraphé deux accords similaires bilatéraux avec Tripoli et Tunis ces derniers mois.

La délégation libyenne, représentée par le Premier ministre Fayez El Serraj, qui s’est déplacé en personne pour demander 800 millions d’euros à l’Europe, renouvelle son engagement à jouer le gendarme de la rive sud. En signant l’accord, Tripoli accepte l’intervention militaire européenne sur son littoral et dans son désert contre la fourniture d’équipements lourds (hélicoptères, bateaux, vedettes, ambulances, jeeps…) et même d’articles de moindre importance comme les téléphones satellitaires, des bouteilles d’oxygène, des jumelles… et la formation de sa police et de ses garde-côtes par des experts italiens.
