EU-Parlament stimmt über Regelungen für Frontex an den Seeaußengrenzen ab

PRO ASYL: Keine rechtliche Grundlage für Zurückweisungen schaffen!

Das Europäische Parlament wird am 16. April 2014 über die so genannte Seeaußengrenzenverordnung abstimmen. Mit der Verordnung werden Zurückweisungen von Flüchtlingen auf eine scheinbar legale Grundlage gestellt. „Die Zustimmung derAbgeordneten ist ein fatales Signal für den Flüchtlingsschutz“, sagte Marei Pelzer, Rechtspolitische Referentin von PRO ASYL.

„[…] Spanish authorities have long denied that its border forces are carrying out summary returns, but recent statements from Madrid suggest it now wants to legalize this practice through an explicit agreement with Morocco within the framework of its bilateral readmission agreement. The agreement, signed in 1992 but operational only since 2012, provides for minimal formalities to facilitate the return of third-country nationals. Undermining the already weak human rights safeguards in the agreement would be a step in the wrong direction, Human Rights Watch said.

La Gendarmería marroquí ha rescatado esta mañana en aguas del Estrecho de Gibraltar a siete inmigrantes, entre ellos dos mujeres, cuando intentaban alcanzar las costas españolas a bordo de una patera.

Según han informado fuentes de Salvamento Marítimo, la actuación se ha producido después de una llamada recibida a las 7.30 horas por el Centro de Coordinación de Salvamento Marítimo de Tarifa (Cádiz) en la que se alertaba de que una patera se encontraba en el Estrecho.

Migrant ‘Push Backs’ at Sea are Prohibited ‘Collective Expulsions’

Collective expulsions of migrants at sea have often resulted in tragedy and are prohibited by Protocol No. 4 to the ECHR.

In the early hours of 20 January 2014, a boat coming from Turkey carrying twenty-seven Afghan and Syrian migrants was intercepted by the Greek coast guard near the isle of Farmakonisi, in the southeast Aegean Sea, and later capsized. Eight migrant children and three migrant women drowned. While this operation was described by the Greek authorities as a rescue, the migrant survivors adamantly alleged that it was, in fact, a ‘push back.’ ‘Push back’ is a widely-used term that has overshadowed the legal term, ‘collective expulsion,’ the prohibition of which was expressly provided for in 1963 in the one-sentence, oft-forgotten, Article 4 of Protocol No. 4 (‘Article 4-4’) to the European Convention on Human Rights (‘ECHR’).

Turkish border: On January 19th, 2014 a boat with 26 refugees (23 Afghans and 3 Syrians) was spotted by the Greek Coast Guard near Farmakonisi. During the illegal push back that took place 8 children and 3 women drowned.

The 3 survivors of the „tragedy“ are speaking about their experience in a press conference, organized by the „Initiative Against the Detention Centers — Athens“ on January 25th in Syndagma Square in front of the Greek Parliament.
