Der Europäische Menschenrechtsgerichtshof hat eine Klage sudanesischer Abgeschobener angenommen. Eine Gruppe sudanesischer Flüchtlinge war bei einer Razzia in Ventimiglia, an der italienisch-französischen Grenze, festgenommen und per Kollektivabschiebung am 24. August 2016 nach Khartum abgeschoben worden. AktivistInnen flogen ihnen hinterher und unterstützten ihre jetzige Klage, zusammen mit ParlamentarierInnen.

Sono stati dichiarati tutti ammissibili i ricorsi presentati dai cittadini sudanesi contro il Governo italiano per il respingimento collettivo che, il 24 agosto 2016, ha dato esecuzione all’accordo tra il Capo della Polizia italiana ed il suo omologo sudanese.

La CEDH condamne la Grèce pour « traitement inhumain » de deux migrants

La Cour européenne des droits de l’homme (CEDH) a condamné, jeudi 11 décembre, la Grèce pour « traitement inhumain et dégradant » de deux migrants arrivés dans le pays sans papiers et détenus dans des centres de rétention.

La CEDH a donné gain de cause à un Iranien qui se plaignait des conditions de sa détention dans les postes-frontières et à un Irakien qui se plaignait que sa condition de mineur n’ait pas été prise en compte lors de sa détention au poste-frontière du nord-est du pays, près de la Turquie.

Migration: Malta loses European Court appeals on shorter detention periods

Malta has lost a final appeal against two European Court of Human Rights judgments demanding that migrants are kept in detention for shorter periods and that conditions at closed centres be improved.

The original judgments – in which Malta was also fined €60,000 – were handed down by the ECHR in July but they were not final as either party had three months to request that the case be referred to the Grand Chamber of the Court.

The government challenged the decisions, requesting a referral to the Grand Chamber in October but the request was rejected last week, meaning the judgments are now final and legally bind the government to pay the penalties and move to implement the ECHR’s recommendations.

Alors que dans la journée nous avons reçus l’information d’un beateau en détresse dans la zone SAR maltaise transportant 300 personnes et nous attendons de voir si Malte respecte son obligation de les secourir, la CEDH a ordonné aujourd’hui l’arrêt du renvois de 45 somaliens par avions vers la Libye.

While we are waiting to see whether Malta effectively rescues 300 people who are in distress within its SAR area of which, the ECHR has demanded Malta to stop the deportation of 45 Somalis to Libya.

The Maltese government has until 30 July to inform the European Court of Human Rights whether it considered the claims of some 45 migrants who were scheduled to be deported to Libya without taking their request for asylum.

In a temporary measure taken by the Strasbourg court, the government was stopped in its tracks from flying two planeloads of Somali asylum seekers to Mitiga airport, Libya, tonight after they had been rescued and brought to shore by the Armed Forces of Malta.

The European Court of Human Rights ruled against Greece in the case of the 29-year-old Chinese Luping Lin, for ill-treatment during detention in Elliniko prison near by Athens in 2010. The European Court of Human Rights has ordered Greece to pay the Chinese citizen 5,000 euros in compensation after wrongly arresting him in Athens and mistreating him during detention. The 29-year-old had entered the country legally in 2006 and obtained a residence permit but was arrested and deported four years later.

European Court of Human Right condemns Hungary for its treatment of asylum seekers

In two cases this week, the European Court of Human Rights (ECtHR) condemned Hungary for unlawfully detaining at the Debrecen Reception Centre for Refugees asylum seekers, pending the outcome of their asylum claims, without effective judicial review of their detention. Both cases concerned complaints under Article 5§ 1 of the European Convention on Human Rights (ECHR) (right to liberty and security).

The first case of Al-Tayyar Abdelhakim v. Hungary (no. 13058/11) concerned a Palestinian national who, after being stopped at the Hungarian border at Záhony (Hungary) in July 2010 for using a forged passport, he claimed asylum, explaining that he came from a refugee camp in Tripoli, Lebanon, where he faced security problems. The applicants in the second case (Hendrin Ali Said and Aras Ali Said (no. 13457/11) were young Iraqi nationals who left their country in August 2009 and entered Hungary illegally, where they launched their first asylum application before being smuggled to the Netherlands. They claimed asylum, alleging that they had been persecuted in Iraq because of their father’s former service in Saddam Hussein’s army and their Kurdish ethnicity. After their interception in the latter, they were transferred back to Hungary in September 2010 under the Dublin II procedure.

„Nach der wegweisenden Entscheidung des Europäischen Menschenrechtsgerichtshofs vom 23.  Februar  2012  („Hirsi  und  andere  gegen  Italien“)  müssen  der  europäische  Flüchtlingsschutz neu geregelt und die menschenrechtlichen Verpflichtungen stärker beachtet werden. Auch Deutschland steht in der Verantwortung und muss Konsequenzen ziehen.“
