Patrick Kroker, a German Lawyer whom we were recently in contact with through ECCHR in Berlin offered this preliminary analysis of the Salamis case that may also be useful to define the legality or illegality of the practice of „privatised pushbacks“.

He asks us to specify that:
„please do make sure to make clear that this is only a brief and preliminary analysis. I only had a couple of hours to work on it today and before being quoted on it, I would like to conduct a more thorough research on the issue. But in case the analysis helps someone „private push back“ cases, I am more than happy, of course.“

updated informations about the „Salamis-case“:
The tanker arrived yesterday in Syracus/Sicily with all 102 boatpeople, coming mainly from Sudan and Eritrea, and starting now their asylum procedures …
And the Salamis went back to Malta in the meanwhile, obviously without any attempt from authorities to try to criminalize the Captain and the crew for their rescue-operation (and as some of us had feared before because of earlier experiences).

All’s well that ends well?

Joseph Muscat comes out politically stronger thanks to the Italian intervention to disembark 102 migrants in Syracuse. But had it not been for Italy he would have had egg on his face.

Thanks to the timely intervention of the Italian government, Joseph Muscat’s sabre-rattling on immigration has politically paid off. His intransigence to refuse the disembarkation of 102 migrants left Italy with no choice but to intervene to avert a humanitarian tragedy just outside Maltese territorial waters.

PRESERVATION OF LIFE SHOULD BE THE TOPMOST PRIORITY – NGOS
Nine NGOs urged Italy and Malta to ensure that all decisions involving the fate of the migrants gave topmost priority to the preservation of their lives.
Aditus, JRS, the Migrants’ Network for Equality, SOS Malta, the Emigrants’ Commission, Kopin, Integra Foundation, the Foundation for Shelter and Support to Migrants and the Organisation for Friendship in Diversity said:
„We remind Italy and Malta that the rescue operation should result in the migrants being disembarked at a safe port. We subscribe to, and strongly urge an interpretation of safe that is not limited to immediate physical safety but which also looks at the human rights situation the rescued persons would be exposed to.

Thirty-one people are believed to have died while trying to reach the Italian island of Lampedusa, the latest tragedy to occur on the perilous sea crossing between north Africa and Europe.Survivors of the journey from Libya reportedly told authorities that the vessel in which they were travelling capsized on Friday evening, and more than half of its 53 passengers drowned. They said nine of the dead were women, the Ansa news agency reported.Pictures on Italian television showed the wreck of a motorised rubber dinghy. The 22 people rescued were from a variety of west African countries including Nigeria, Benin, Gambia and Senegal. […]“
