On February 28th 2017 the second level court hearing against ten of the Röszke 11 – all but Ahmed H., who was sentenced to ten years of prison in a separate trial – was held in Szeged. The only person remaining in Hungarian custody and therefore present at the court hearing was Yamen A. The other nine people have left Hungary some month ago and claimed asylum in other European countries. Albeit two of them left Europe under the “voluntary return” act due to the immense pressure imposed on them and the threat to deport them back to Hungary under the Dublin Regulation.

Am 28. Februar 2017 findet in Ungarn ein Revisionsverfahren statt, in dem über das Schicksal von Yamen A. entschieden wird. Der 21-jährige Syrer ist seit September 2015 – also seit knapp eineinhalb Jahren – in Ungarn in Haft. Der Vorwurf: „Illegaler Grenzübertritt“ und „Teilnahme an Massenunruhen“. Im Juli letzten Jahres wurde er deshalb zu drei Jahren Gefängnis verurteilt. Dies ist sein Revisionsverfahren. Es findet in Szeged statt.
Yamen A. kam im Jahr 2015 als Flüchtender aus Syrien nach Europa. Er hatte in Syrien zuvor Psychologie studiert und floh vor der Zwangsrekrutierung der Armee aus dem Lande. Seit 17 Monaten sitzt er unschuldig im Gefängnis.

Ahmed H. was sentenced to 10 years imprisonment because of „terrorism“ in November. On the 28th of February there will be a second level court trial about the other ten of the Röszke 11, who had their first verdict July last year. From these 10 people only Yamen A. is still in prison in Hungary. The other 9 people finished their sentence and left Hungary.

Yamen A. was sentenced to 3 years in the beginning of July last year. Since then he is in isolation imprisoned in Szeged. The “reason” why he was sentenced to greater punishment than the other 9 accused is that Yamen was talking 10 minutes to a megaphone on the 16th of September when thousands of people were protesting for the freedom of movement.

Ong che salvano i migranti: due procure sospettano complicità con gli scafisti

Il tempismo e il coordinamento con il quale le diverse sigle sono intervenute per caricare i disperati del mare fanno pensare a rapporti con chi organizza i viaggi della speranza

Le procure di Catania e di Palermo hanno aperto due indagini conoscitive sulle operazioni di soccorso condotte nel Mediterraneo da un gruppo di Ong. Come riporta „Il Giornale“, il sospetto è che alcune delle navi solidali impegnate nel salvataggio dei migranti abbiano avuto contatti con gli scafisti. Il tempismo e il coordinamento con il quale le diverse sigle sono intervenute per caricare i disperati del mare, fanno pensare infatti che le partenze e i movimenti dei gommoni fossero loro note prima ancora della partenza. I due fascicoli sono stati istruiti dopo le segnalazioni dello Sco, il Servizio centrale operativo della polizia.

Italy is looking more closely at the role of privately-funded rescue operations that have been plucking migrants from the seas off Libya and into the possibility that there may be collusion between smugglers and some of the rescuers.

A Sicilian prosecutor has told the news agency AFP that the cost and sophistication of the rescue operations had attracted attention.

“There is an abnormal proliferation of NGOs [Non-Government Organisations] operating “ said Carmelo Zuccaro, Catania’s prosecutor, “I’m not talking about the big, prestigious organisations, but all the small ones that seem to have sophisticated hardware, such as drones.”

Davanti al tribunale d’Imperia, sotto un sole primaverile, una cinquantina di persone, molti francesi, accompagnano Felix Croft verso l’entrata. «Solidarietà ai migranti, solidarietà a Felix» si legge su un cartello. Un altro riporta date e luoghi dove alcuni attivisti sono stati arrestati per lo stesso motivo. I suoi familiari entrano con lui. L’accusa che conduce il 27enne francese sul banco degli imputati è pesante, favoreggiamento dell’immigrazione clandestina con l’aggravante di aver trasportato 5 persone, una famiglia. La pena va dai 5 a 15 anni. Nelle tasche di Felix, hanno dichiarato in aula i due carabinieri che lo hanno arrestato, non sono stati trovati soldi.

Frontex hat die Staatsanwaltschaft Catania dazu veranlasst, die NGO Initiativen zur Seenotrettung im Mittelmeer zwischen Libyen und Sizilien aufs Korn zu nehmen. Italienische Medienberichte legten nahe, dass bereits ermittelt würde, nun rudert Staatsanwalt Carmelo Zuccaro zurück: Es sei kein Verfahren eröffnet worden, aber die NGO-Seenotrettung sei in die staatsanwaltschaftliche Beobachtung der Schleuserkriminalität im zentralen Mittelmeer integriert worden. Als Grund gab Zuccaro an, dass der Einsatz teuer High-Tech-Aufklärung und sogar von Drohnen durch die Seenotrettungs-Initiativen „anormal“ sei

Das zentrale Mittelmeer wird derzeit elektronisch durch EU und USA stärker überwacht als jede andere Meereszone. Dennoch ertranken vor den High-Tech-Augen der EU- und US-Militärs in den letzten Jahren Abertausende Menschen, allein im letzten Jahr 5.000 Boat-people. Die NGO-Seenotrettungen kämpfen verzweifelt darum, Schiffsbrüchige in der Todeszone vor Libyen rechtzeitig zu erkennen, um sie retten zu können. Die dafür eingesetzten High-Tech-Mittel sind nur ein bescheidener Anfang und stehen in keinerlei Vergleich zu den hochmodernen milliardenschweren Maxi-Techniken der Abschotter.

Migranti: inchiesta pm Catania su Ong

Atti conoscitivi dopo denuncia Frontex di contatti con scafisti

(ANSA) – CATANIA, 17 FEB – La Procura di Catania ha aperto un’inchiesta conoscitiva sugli interventi in mare per soccorrere migranti da parte di Ong nel Canale di Sicilia. Lo scrive Repubblica citando il procuratore Carmelo Zuccaro che al quotidiano spiega: „vogliamo capire chi c’è dietro tutte queste organizzazioni umanitarie che sono proliferate in questi ultimi anni, da dove vengono tutti questi soldi che hanno a disposizione e soprattutto che gioco fanno“. Per questo, aggiunge, „insieme a Frontex e alla Marina militare stiamo cercando di monitorare queste Ogn che hanno dimostrato di avere una grande disponibilità finanziaria“. „E‘ ovvio – sottolinea Zuccaro – che non mettiamo in discussione organizzazioni umanitarie di chiara fama“. Secondo un rapporto di Frontex all’Ue ai migranti „verrebbero date chiare istruzioni prima della partenza sulla direzione da seguire per raggiungere le imbarcazioni Ong“, le cui navi spesso si spingerebbero vicino la costa libica come dei ‚taxi‘, ipotizzando presunti „contatti con scafisti“. Davanti alla corte del Tribunale di Imperia, Felix Croft si è difeso con queste parole dall’accusa di “favoreggiamento dell’immigrazione clandestina, un reato che prevede pene fino a 15 anni di carcere. In un aula di tribunale blindata e gremita di pubblico e stampa internazionale, alla quale non è stato consentito di filmare l’udienza per “per ragioni di sicurezza”, Croft ha ripercorso la genesi del suo gesto.

This study was commissioned by the European Parliament’s Policy Department for Citizens’ Rights and Constitutional Affairs at the request of the LIBE Committee. With renewed efforts to counter people smuggling in the context of an unprecedented influx of migrants and refugees into the EU, it assesses existing EU legislation in the area – the 2002 Facilitators’ Package – and how it deals with those providing humanitarian assistance to irregular migrants. The study maps EU legislation against the international legal framework and explores the effects – both direct and indirect – of the law and policy practice in selected Member States. It finds significant inconsistencies, divergences and grey areas, such that humanitarian actors are often deterred from providing assistance. The study calls for a review of the legislative framework, greater legal certainty and improved data collection on the effects of the legislation.
